I'm optimistic that the Trust will not be considered a disqualified person based on the IRS definition... (5) any direct or indirect owner of 50% or more of any of the following:the combined voting power of all classes of stock entitled to vote, or the total value of shares of all classes of stock of a corporation that is an employer or employee organization described in (3) or (4);the capital interest or profits interest of a partnership that is an employer or employee organization described in (3) or (4); orthe beneficial interest of a trust or unincorporated enterprise that is an employer or an employee organization described in (3) or (4); The 3rd bullet references a Trust and it mentions the beneficial interest and not the trustees.

Reference the Howey Test for determining if something is an investment contract:"a person invests his money in a common enterprise and is led to expect profits solely from the efforts of the promoter or a third party," To the original poster - there are plenty of vanilla operating agreements you can find online, you can get one from Legal Zoom for very cheap.

Yes, I did speak about it at the Summit and you can purchase a recording of the entire conference right here on BP.As far as recent changes, most of it is not changes to the land trust itself or the strategy, but that the market has changed and the inventory of REO's (which this worked so well with) has dropped considerably, thus less opportunity to utilize that method.Another change I have noticed is that the bank will now often require to see the trust bank statement to match the name vested on the contract. before, I would have "Will Barnard" as the trustee and the bank account for the POF was under "Barnard Enterprises, Inc" my corporation.
