Normally you would choose an inspector that does carry liability insurance, it's wise to do and in principle the inspector is liable for this if indeed it was an issue that should have been noted/found upon inspection.Even with an exculpatory clause if you decide to sue it could be ruled that his exculpatory clause is not applicable as it may contravene other legislation in state to protect buyers.I suggest you first seek information from your home insurance and find out where you stand on it with their liability and then if that doesn't yield or if indeed you want to take it further speak to a Real Estate Attorney in your area.You may want to approach the inspector themselves to see if they are willing to fix it rather than go through any formal proceedings but I strongly suggest you get your own legal counsel before doing that.
