If this is thousands you might want to at least get a counsel consultation to see what the options are and chances of monetary recovery. 3 weeks is a lifetime for a contractor to have your cash.

However, I am unable to qualify for any bank financing as my credit score is in recovery.

With current rents having tripled since then, they are still negative cash flowing and haven't seen any appreciation (just a bust and a recovery), but the renters are covering most of the costs now.  

Many, if not all, of the government entitlement income types are not so the likelihood of recovery goes way down.

That said, I don't foreclose in junior position unless the numbers tell me i'll get recovery above and beyond the senior lien amount.

This is why people like me don't respond to certain queries - those who don't treat this as a business have broken fundamentals, while those who do (and have common sense) are worth talking to.I sometimes participate on here (this forum) when I have leisure time and get tired of reading poor advice (of which there is plenty) from inexperienced people dispensing their wisdom (especially questions about LLCs and land trusts) or gurus screwing others over (I was instrumental - as documented on here by the victim - in their recovery of tens of thousands of dollars).  

Plus I'd have to pay the depreciation recovery tax as well (although I'm not too worried about that).

He's much better now but because of the meningitis, during his recovery he couldn't work at all and his wife couldn't either because she had to stay home and take care of him.
