at least here in Florida on the second page it has a check box that establishes that unless the box is check , seller must deliver property free of tenants , and occupants and future tenancies..See if you have something similar on your contract and if you left it blank then your are safe and can fight that back.

I bet if you look at the settlement paperwork from the purchase, there's 4 legal descriptions, 4 APNs, etc, and you actually got a blanked mortgage secured by all 4.

I can't think of any savings account that would guarantee 4% compounding growth, and for what it's worth, banks hold more Life Insurance than any other person or institution for similar occasions as the one you're asking about.

Buying a tenant occupied house is rarely successful, most of them stop paying as soon as you close they might have a prior agreement with the seller or just jumped on the occasion, when investing out of state always pick a vacant house and make sure the tenant is properly vetted by your manager.
