In my Commercial mobile home policy that I pay for in my escrow with my mortgage payments it states that it covers against vandalism and malicious damage EXCEPT when done by the tenant, members of tenant's household or tenants employees.

(a) Every landlord shall:(1) within three weeks after termination of the tenancy; or(2) within five days of the date when the tenant leaves the building or dwelling due to the legal condemnation of the building or dwelling in which the tenant lives for reasons not due to willful, malicious, or irresponsible conduct of the tenant,and after receipt of the tenant's mailing address or delivery instructions, return the deposit to the tenant, with interest thereon as provided in subdivision 2, or furnish to the tenant a written statement showing the specific reason for the withholding of the deposit or any portion thereof.

I've found the problem with prosecuting someone in the US at least, is first figuring out who has jurisdiction, next, getting them interested in prosecuting a white-collar crime, particularly when the ultimate victim is an insurance company whose business model is assuming risk, then finding the perpetrators, difficult since many times the one you can identify is a front for the main bad actors, add in the time, money and resources that need to be expended to get it in front of a jury who may find reasonable doubt and acquit and most insures I've worked for decide it is a business risk, pay the loss, see if there is an easy fix and move on.

I’m wanting to know as a landlord how to better protect yourself and your investment being that there really is no gain in a rental property unless the rent payment is received and you don’t have malicious tenants try to avoid paying rent, or affect you in a way to rob you from that income like in faulty allegations or habitability issues that then need an attorney or going to court.I have heard of wise landlords using a guarantor service that pays the rent if the tenant stops paying for whatever reason.
