A lady called me today, said she meets our Minimum Qualification Standards and we scheduled a tour tomorrow morning at a rental. She then goes on to tell me that she needs a place in immediately because a 90 year old con man stole her house by going to the title company and telling them her brother murdered her mom, which is true but how did he know that, and the title company didn't think an old man would lie so they gave him the title. And he had her removed from the house, and she only has the clothes on her back. And she has documentation from her legal team as proof, and the man is selling her house to someone oversees.

WHAT?! How the heck do I get out of this tour now? Do I just cancel and then blow her off if she follows up? Oh my gosh.

Also, should I require additional deposit from the new roommate?

I am hoping one of you will have maybe encountered this situation and can offer advice:

Two guys on a lease. Guy 1 is breaking the lease to move across the country. Guy 2 wants to move in his best friend. Guy 1 is paying me a lease break fee to have his name legally removed from the lease. Guy 2's new roommate is having his mom cosign.

Should I just dissolve the original lease and write a new one?

@Joe Splitrock wow thank you for that info!! I actually hadn't thought of it that way before. I didn't know that, if it isn't in the lease, you can't do it. But that makes sense because the lease doesn't say "Go ahead and leave when you want." Lol

Isn't the deposit a separate thing though? I thought there were laws about what the deposit could and could not be kept for. Or is it just that they are breaking the legal agreement so they don't get the deposit back?

@Julie Hartman thanks for the helpful reply! What do you mean by covering all my bases? Just looking up the law? I checked the lease and it does say the refund will be returned to all parties jointly.

The tenant leaving early says he's the one who paid the deposit. He's wondering when he'll get it back (he knows it is dependent on damages clean up etc). I told him not until after the lease is over, and if the lease is renewed, after that. But is he the one who gets the deposit back if he breaks the lease? I know I need to re-read their lease but I don't think it mentions this specifically.

These are all such great replies!! Is it legal to insist a local therapist has prescribed the ESA? I have another applicant who is a traveling nurse who is just moving here. She gave me a form from a therapist that says he had treated her and is well aware of her mental health disabilities... I'm going the check out the pet screening website for sure!

@Caroline Gerardo I would love to be able to say that, but I haven't found another renter! Do you think I can say no to the other dog (non ESA)?
