Only if you refinance, which means going thru the qualification process again. You calling up the lender and requesting a name to be removed isn't going to get it done.

my perception is the reality of the situation as far as I'm concerned. He has his way of property management. I just wouldn't want to be the tenant that has to use space heaters because my landlord thinks I'm too stupid to have a functional furnace. I'm done with the issue.

My point was clearly stated. He would rather put this woman and her kids in danger in the pursuit of profits @Account Closed

If @Chris K. hadn't basically been peer pressured into calling out a service tech by members of this board, this lady and her kids could be sitting in a house with space heaters and a furnace leaking CO. That's both scary that this guy as a landlord would put people's lives at risk and even scarier that he thought it was OK and saw no problems with it.

Justin,

The judge allowed the case to go forward but the officers didn't show up to court. In order to not waste my time with a rescheduled court date, the judge allowed, with my permission, to let the officers be excluded from the case. So in the end it was me suing the entity. I did this because the entity, was a large franchisee of Midas and Napa auto part stores so I felt confident that I would get paid if I won money. I did end up winning 5k from the company and their insurance company paid me a week or so after the court case. In this case, suing the officers probably wasn't needed but I did it to make a point that I was serious and would come after anyone with a fiduciary duty to the entity to let them know I was not going away. I tried to be civil but got the run around from them for about 3 or 4 months before I decided to file a lawsuit.

I just brought a lawsuit against a company earlier this year. I sued the entity as well as every single officer. My case went forward.

What most people don't understand is that having any type of corporate entity won't save you from lawsuits. Just because you have an LLC doesn't mean that you can't be held legally responsible if someone slips and falls on your property. If you have been grossly negligent, I can assure you any competent attorney will file a lawsuit in the name of your LLC and all the officers of the LLC, as well as your tenants. Suing everyone all but kills the "keeping my assets" seperate argument. I think most just get these useless LLC's to feel important I guess. It has been proven time and time again, a corporate entity won't stop a legit lawsuit and surely won't stop an attorney for coming after your assets weather business or personal.
