Post: Tenant Leaving 3 days after the end of the month

Hi BP'ers

My tenant, who is on a month to month, notified me that she would be moving out on February 20th.  She did pay rent for the whole month of February.  I called her yesterday to confirm that she would be moving out and she said yes.  However, she said that she is moving out on the 2nd or 3rd of March.  I told her that moving out on the 2nd or 3rd is not acceptable and she has to move out by the end of February.  She said ok, but did not sound like she meant it.  

My questions are..

1.  Is there anything that I should do to ensure that she is out by the end of the month, February 29th.

2. Is there anything that I should be aware of or do if she stays until March 2nd or 3rd?

I truly believe that she will be out within the next two weeks, so I don't think that starting an eviction process will be worth my while.  I have a feeling that there is something I may be missing but I am not sure what it is.

Sounds just like a situation that I had a couple of years ago.  But it was a single mother on social services with 4 young children (below 18 years) - next thing I know two adult children have moved in.  Three times in court for non-payment and each time she came up with a voucher or some sort of charitable assistance.  Even with a rent payment responsibility of $70 per month, she still could not pay.  I finally moved forward with the eviction and held firm with my decision when yet another charity promised to pay her back rent.  

She was always pleasant and appreciative, but I finally kept my emotions out of it and made it purely professional.  Best move I ever made.

@Victoria Riggs just because you live in LI does not mean that you have to invest there.  There are PLENTY of great areas within a 2-3 hour drive that has to potential for great investments.  

Take some time to travel and drive to other areas to see what's what.  From Pennsylvania to upstate NY,  the opportunities are there.

So...what ever happened to the original written lease?  Did you inherit this tenant without a lease?  How did the tenant first move in?  Just curious.

I would also suggest that moving forward, you may want to take photos of all appliances to prove proof of damage that is not normal were and tear. Or you can document it on your walk through checklist.

@Ken DayalYou could request your tenant to provide proof of layoff but i guess that you should ask yourself "is it worth it?"  How much notice is he giving you.  Jersey City is a hot rental market and I am pretty sure that you could get it re-rented quickly.  

Perhaps you could let him know that you will set an expected move out date and in the interim you will show the property to prospective tenants.  The alternative may be that you do not let him out of the lease but he ends up not paying the rent and you will have to evict him.  How long will an eviction take?  Is it worth it?

@Gina Ruffand @Jim Adrianhave made 2 very good points.  The wording, which you have already mentioned that you will adjust....and the colors should be changed. The green and orange background simply clash.  I think that you should get rid of the orange background and leave it white, with colored lettering.

@Kris Haskins, you are my motivation and inspiration.  I always go back and forth between paying down my mortgage and saving for the next deal.  The sweet sense of relief knowing that there is one less debt to deal with is such an amazing relief.

You would have to find a lawyer to fight this battle for you.  

More than likely, Yonkers is a city that does not allow bandit signs.  Each town, city or municipality is different.  Check with city hall and if it is not permitted, take them down ASAP.  Yonkers most likely wants your name to contact you themselves and ask you to remove the signs or ticket/fine you.
