@Kim F. Its not that you cant use end buyer funds. Its because there are way to many strict restrictions on short sales so you cannot do a double closing or assignment of contract. On top of the restrictions the short sale gets approved and there is an approved buyer for an approved amount. The buyer approved is the buyer that needs to buy the property. We used to be able to do the wholesale short sales all the time but not anymore. They figured out what was going on.

Thanks for the plug @Doug Vigliano! @Jessica Ayala I am actually working on your quote you requested as we speak! lol Doug is right about the deeds. Most of the time the warranty deeds are insured transactions and QCD's are just to transfer title with no warranty. Although you can transfer title with no title insurance or warranty and still record a warranty deed. From a title closing stand point when running our title search we always go back to the last deed that was an insured transaction sometimes going back several deeds. Specially if the property was deeded back and forth through family members or what not. Then once we find that insured deed we work forward from there because if there are any issues with title prior to that then it will fall on that owners policy. We check for any title issues including deeds that are prepared incorrectly. But to answer your question it really is not more complex. Your title company will make sure you have clear title and will get the proper affidavits or corrective deeds if necessary.

I am with an investor friendly title company here in central FL and I am a HUD approved closing agent so I close lots of these HUD home deals. As a title agent that works with mostly investors I cannot disclose how you can go about purchasing properties through HUD but if you need help with the closing process please let me know. I am sure you will get lots of good information from investors on here about purchasing from HUD.
