i'm going through something similar. 

Current tenants have been there for about 3 years. new tenant moved in a few weeks ago right above them.

New tenant asked old tenants to please be quiet, that they talked very loudly. ( this was at 8:30AM on a sunday, new tenant had just moved in the previous day. )

all seemed to be okay.

Now i get a call from both tenants who are upset. Old tenants say new tenant was banging on the floor. new tenant says they were playing either the TV or audio books late into AM hours. ( 1:30-2AMish ) 

Next day, old tenant goes to talk to new tenant. both agree they were having a civil conversation, until old tenant's husband gets involved and goes berserk. tells new tenant he doesn't belong, leave.

new tenant closes the door and calls me the next day.

My side. Old tenant is kinda loud from time to time - during the day. I've heard them while working there, but during the day, i'm not going to say much of anything about it. At night, after 11PM. different story. Old tenants claim they were not playing the TV or anything in the morning hours.

so one big he said she said scenario.

talked with both tenants. remained fair to both sides. told them we can't have this fighting. no one is going to win. i also reminded them that if they can not have civil discussion, then don't have one at all. i will not tolerate yelling and screaming inside the common areas of the property. period. 

that was two days ago.

hoping this issue goes away, because i don't feel like babysitting.

Yes, you were right Matt. The lease covers abandonment issues. ( can you tell I am still a bit new to this? )

So basically, if he doesn't pay next month's rent, and the unit is not occupied by him for two consecutive weeks, I can consider the unit abandoned. 

It also states that I should send a letter notifying him of the breach. Since I have no forwarding address, I will have to send it to the address I have on file.

Nicole - I did not tell him he could move out early, or release him from the lease. Upon his text that he was leaving, I gently reminded him of his responsibilities. All of this happened very quickly. Nothing in writing. Had no chance too! lol

Matt - I will look at the lease. It is a state of Wisconsin lease drafted by attorneys. I am pretty sure if does say something about abandonment - thank you for reminding me. I will go look.

Had a tenant text me last week that he left his job in the area and would be out of his apartment by Oct.31st.

His lease ends the end of May 2016.

I reminded him that his lease was through May of 2016, and we would make every effort to rent it, but that he would be responsible for the rent till we got it rented or his lease expired.

He said he might know someone who would take it, then added that he would be moved out by the weekend and would leave the keys.

This weekend came and went. Went into the apartment, it was cleared out, VERY dirty, but no keys.   ( No noticeable damages at first glance. ) I didn't want to linger around just yet because to me, not leaving the keys says he still has possession. 

Texted him about the keys and whether he was out of the apartment or not and haven't heard a peep from him.  No forwarding address either.

I suspect he is having some bigger issues, hence the picking up and leaving so abruptly. Maybe legal issues, but I would only be speculating. He was a good tenant, and this incident, to me, is out of character. 

I'm just not sure how to proceed now.

Ned, I usually search their name followed by location, or their name with phone number while i am logged into my facebook account. this has worked very well for me. i wouldn't ask for their SM on the application, otherwise they will clean it up!

I do too. My opinion is that if their SM pages are open to the public, then it is fair game.

While processing a recent application, I did my normal social media search. Turns out, like many younger prospects, their SM page(s) are left open for all to see.  On this particular occasion, I saw several posts about 'Dabs and Dabbing'. I never heard of it but suspected it was drug related. And sure enough it was. And it is quite the elaborate process and dangerous. ( blow torches and such...not in my units, thank you! )

I had never heard of this term before! Learn something everyday I guess. 

Just wanted to pass it along in case it helps someone else out.

Just thought I would start a thread about the weirdest, funniest, and most common requests from tenants you've had where they state, 'it's the law', when you know it is not.

My most recent one was an inherited tenant telling me their unit wasn't painted when they moved in and that 'the law' says it must be painted when a new tenant moves in. 

Made me chuckle. I paint between tenants but not because it is the law, but again, this is an inherited tenant who I think just wants their unit repainted. 

Let's hear 'em!

and one more thing. i would not give them their SD back on the spot. make them wait the allotted tome you are allowed. you never know what you'll find later, and, they are trying to dictate to you how to run your operation. Just make sure you have pictures and document everything. not saying you have to ding them for anything, but follow the law, and don't cave in to their demands.

i go by the above. i am in wiscosnin too. i haven't had an issue yet with a vacating tenant refusing to have their carpet cleaned. good luck!
