Shane... always remember that when selecting tenants your decisions cannot be made based on your concern that a child will mar the surfaces.

Families with children enjoy all of the housing protections that just about every other class does.

As for a two year old... in my experience it is the 13 to 18 year olds that are the biggest pain.

WOW...

Focus... your problems and issues demonstrate that some people might not be the best landlords. Nothing personal... but landlording can be a tough business.

As mentioned above... tenants should never be your friends... and if you don't manage them wiht purpose from the beginning they will just take more and more.

The best advice you received in the responses is to hire a lawyer and then sell the property.

Mark... it is not a matter of location. I cannot think of lender who will allow an assignment. Also, most lenders will not allow double closes... this is controlled by restricting how long the property must be held prior to another sale (deed change).

With that being said, there are ways around this restriction... the most popular is to put the property under contract in and LLC and then sell the LLC to the ultimate buyer. The purchase price for the LLC would be your assignment fee.

First follow the lease...

Then, you have two choices... keep the tenant and her potentially bankruptcy inducing pit bull... or demand that she get rid of the pit bull.

Don't waiver... that pit bull will cost you much more money then the loss of this tenant.
