 I find that offensive and unsubstantiated.  I asked for a real opinion , hoping to get an opinion from professionals.  Instead I just get hearsay/opinions from people who have no idea what the reality or recourse of the situation is...   I for one don't make comments when Im just speculating, and I find it unprofessional and insulting for someone to give an opinions based on absolutely no knowledge or research.  Eh, I guess this is why we have courts, to cut through the bull **** and get to the truth.

Maybe you should try reading, you might learn something. I never said that second-hand smoke was not a health hazard, I said that smoke stains are not. There is NO SMOKE in your house, only smoke stains. Of course, they would be toxin if you decide to lick the walls. 

Did YOU sign the lease without seeing the home?

 Weird, because MOLD .... in an of itself is toxic, when licked, and also toxic THROUGHOUT THE AIR.   (THE QUESTION HEREIN, IS,  ARE CARCINOGENS OR AIRBONE CARCINOGENS ALIVE AND WELL AFTER THE SMOKE HAS CLEARED) 

You cannot say that cigarette smoke lingering in a home is non toxic when you have not done the research that would be completely misguided.  HOW DO YOU KNOW ?  Did you do a scientific study? didn't think so...  Your argument is invalid .

Of course its not illegal for landlords to allow tenants to smoke in their properties.

BUT - IT IS ILLEGAL TO PROVIDE AN UNSAFE LIVING ENVIRONMENT TO THE NEXT TENANT

I don't want anyone to think I am trying to take advantage of someone or sue someone for my own benefit

However, I have had a serious cough, and also have had problems running/excercising/ doing my daily abilities, and I believe it to be due to this home which has been provided by the landlord who has been accepting our rent checks every month with no issue.  

I believe he is liable, if he provided an unsuitable living environment and made a profit doing so, wouldn't you agree if this was your home ? 

I live in this place with 2 clients who needs my assistance, thus this is also my place of work.  We DID have permission to paint, and we added monumental value to the property by painting it a nice egg shell and flat white ceilings.

I PAID CASH FOR MY FIRST HOUSE AND OWN MANY UNITS ( PAID FOR CASH ) .....

I did not know IF THERE WAS OR WASNT SMOKE DAMAGE , it was discoloration for sure.

My question is not one of what your opinion is , my question is of the LEGAL RAMIFICATIONS for a property owner, providing an unsafe rental for tenants, by way of 2nd hand smoke from a  prior tenant.

YES I CHECKED THE LAW BOOKS IN THIS COUNTY, theres nothing there for 2nd hand smoke due to the fact that it is rarely and barely ever used in legal discussion 

My name is Nick and right now, I am currently living in a rental home.  Upon moving in, I painted the walls and ceilings noticing discoloration.  The previous tenant smoked in this home, and I am afraid that my healthy is being compromised as a result of the previous idiot's smoking.

I am wondering, is there a lawsuit here, can I get this idiot landlord for providing an unsafe living environment? 

I had suspicion that the previous tenant smoked, but I did not ask the landlord, nor did I know for sure, but now I am pretty sure.

Also, I believe that the ducts may be bad, and there may be mold..... Is there a suit for that?
Because this guy is the cheapest SOB in the entire world, and if he has compromised my health for his profit, I feel that that is lawsuit worthy

What are your opinions?
