@william jones, I personally had a similar situation on an inherited tenant who defaulted after 3 month of acquiring the property. She stopped paying in June and I served a notice to QUIT followed by Dispossision.  On court date she appeared on court and we came to a settlement of $900 and vacate the property on July 22.  On July 22, she vacated but didnt pay the $900. she took the stove and fridge which was in the property and I kept the deposit money. 

Try to reach to an agrement with tenant (vacate in 3 days or 5 days and not more than that) and if she dont leave, it immediately trigger a writ of possession and you can go to mashals for eviction. (this is expensive and time consuming).

Thanks for your responses. last week, i have notified the tenant about the eviction proceeding as a courtesy so that he can find a place for his 3 kids before the marshal kick him out  however he still staying with his kids even now. 

Now that the date is scheduled, what are your thoughts on notifying the tenant ?. should i be repeatedly warning him about the upcoming event ?

We have scheduled an eviction process with Marshalls office next week. The tenant is still living in the house with kids.  House is located in Dekalb county, Georgia.

We would like to know about what to expect and be prepared for the unknown.

Marshall office told us to  :

1. 5 movers for moving stuffs 

 2. Keys to the apartment unit (or lock smith).

3. Trash bags

4. Do not go in or knock until Marshal let us know. 

Any thing else. ?. share your experiences so that we will be prepared. First time we are dealing with the eviction.

want to give an update on the situation. Court Approved the writ of possession and now it is scheduled for eviction with marshals office. Its a loonggggg and lengthy process.

Question :

The marshals office scheduled for evicting the tenant next week of friday (8/10). Should I notify the tenant before then ?.

My concern is that tenant got 3 kids and not sure where they will be after the Marshal kicks them out.

(Tenant is living in the unit since Mar 25 and NOT a single dollar as rent). Judgement against the tenant is with us to collect $3500 from the tenant.

@Peter M. Thanks for the detailed explanation. I am happy for the community support, Tenant left her wheelchairs which she want them back inside house. Can I use that as leverage to get appliances back ?.

@Peter M. Thanks all for the response I want to give an update about the situation. Tenant moved out and LEFT all trash and some stuffs in the house. Left a truck, car and a large trailer in the backyard. In addition she took the electric stove(2 mo old) and the refrigerator. Today i cleaned the unit, moved some of her leftover to a corner and changed locks She left her 2 wheel chairs in the unit. She didn’t pay the court agreed $960. I have a deposit $575. Pls advise what to do about the money and appliances. Shall I proceed with writ ?

Consent judgement is below The parties agree that defendant is liable for rent at $525 for June and $367 for July. Defendant owes principal 892 and court cost of $75 for a total judgement of 967.50. Defendant didn’t request a payment plan. Defendant shall vacate the property by July 21 2018. If defendant fails to vacate writ of possession shall issue upon written request. Plaintiff shall inform court within 40 days of satisfaction of judgement. Judge signature

Act and Handle this professionally and legally.  Law and judge be the decision maker and ultimately he will have an eviction in his records. He dont have any ground to stand. I am going through a similar situation. The tenant was a fraud and he gave me deposit and rent checks which returned back in April. Since April, I went to Court 3 times because in between he filed for bankruptcy which cost me another $1000. 

Long story short, the tenant is still staying in the house with out paying a single penny for last 4 months. At last Court ordered favoring me last week and $3500 in penalty. I am looking forward for the writ and the Sherif to kick him out.  That will be my happy day..

Hello Bp

My tenant in the duplex property was defaulting on rent and after eviction filing,  we came to a mutual agreement which was signed by Judge to make the rental dues (900) and leave the property on 7/21. 

Morning I reached out to the tenant and she told me that she will let me know by end of the day. By 7pm no indication of moving.

What should I do. ?. please advise
