Indiana law  specifically provides that tenants have any and all rights, quiet and enjoyment and otherwise, until the date so ordered by the court as part of eviction proceeding whereby the tenants are to vacate the premises and return possession of landlord. 

I strongly advise not making any repairs until the tenants have vacated, as damages may occur. You may try and offer "cash for keys" initiative to motivate them to vacate sooner. 

Regardless you must give them "reasonable" notice, which the standard is 24-hours, if you need to access the property for maintenance or what a "reasonable person" may deem to be an invasion of the quiet enjoyment right.

As you have already learn, Anderson is not really a suburb of Indianapolis. Anderson is in Madison County versus Indianapolis in Marion County.

However, you can find some good buys in Anderson but it is definitely tricky. I used to have one of my satellite legal offices in Anderson for about 6 years. It is primarily a rental market. The revitalization in the city has been improving over the past 8-10 years but has been really, really slow. When General Motors left the community in the late 80s, the city lost over 27,000 jobs. It, in essence, became a ghost town, as a majority of the population all worked for GM.

You are starting to see more and more development on the I-69 corridor between the Northeast side of Indianapolis to Anderson. Years ago, I was part of the team that helped to attract the Nestle facility on I-69, along with other industries in the Flagship Enterprise Center (the technology incubator). 

Anderson still has a strong presence within the automotive and logistics industries. More and more international automotive-related companies are targeting the Anderson area, which has helped to jump start the revitalization again. The cost of living in Madison County is much lower than compared to Marion County. "Live in Madison County, work in Marion County" used to be the motto but that is slowly changing now with the State of Indiana Economic Development Corporation and Department of Transportation targeted funding and focus on the I-69 corridor. But many individuals still do commute to Indianapolis. It's basically less than a 30-minute commute from Anderson to the Northside of Indianapolis.

The Paramount theater is beautiful! It was restored about 6-7 years ago. If you haven't been in it, you most certainly should when you are in the area. The parimutuel horse track and casino, Hoosier Downs owned and operated by Churchill Downs, is a significant attraction to local patrons given the local mall is basically non-existent. Many residents will now visit the outdoor mall off of Exit 210 on I-69. This mall also attracts a great deal of residents from the Town of Pendleton, also in Madison County and closer to the Indianapolis area.

Ken,

Congratulations as well on your success on the Northside of Indianapolis. This can be a tough area for investments but you have done it successfully.

I agree with Chris that you may want to look at wholesalers for inventory that are off market. I have clients that do this successfully and are always looking for other investors. You also may want to extend your targeted area, as you have found. Widen the net, so they say.

I agree with Beverly and others that Indianapolis is a really hot real estate market at the moment. Cost of living is relatively low compared to other US cities. You can get more for your money here.

Post: Quiet Title Action Attorneys Needed

I can't speak to how other states and jurisdictions treat quiet title actions. However, in in Indiana, you cannot use a quiet title action to get around an individual's right of redemption. The quiet title action is used as a legal instrument once the tax title deed is issued to then clear any title defects that may still appear in the "chain of title" that are attached to and encumbering the property from the former owner or other creditors.

If the point is to get around the due process rights of an individual during the redemption period, I would be extremely cautious and consult an attorney in the proper jurisdiction as to whether what one is attempting to do is even legal.
