Post: Seller of home passed away

Hello BP I am looking for some guidance in a situation I’ve never been in before. I’ll try to make it as to the point as possible. We had been working with a potential seller of a vacant home for a few weeks and before we could actually get the deal done and paperwork signed he passed away. The home was in his mother and fathers name (both deceased) and the home was to go to him. Before he passed he put us in contact with his sister because she was going to be his power of attorney as he was terminally ill. Fast forward a month we are now working with the sister on getting the deal done and getting the money to her, however from what I know as of now she is only on the parents will to receive a certain amount of money....not the home. I’ve spoke with the title company and they told me to get the contract in and they would start working it and let me know what I need. We negotiated a price with the sister and have a contract signed and turned in. My big fear/unknown is I’m not 100% sure if the sister can actually sell us the property if it’s not in her name and it’s not going to her in the will. I’m willing to do anything that is needed because this would be a win win situation because they want nothing to do with the home and when we were originally working with her brother that passed he was adamant that when he sold it the money was going to her anyway. We all want to get this done, but at this point we’re kinda waiting on the title company to tell us what to do next so I thought I’d post here and see if anyone has any insight. I’m buying a house and the seller is willing to pay my 20% down payment. The loan company told me they can’t allow the seller to do that or gift me the money. I’m wandering what other options I have because I definitely need that money from the seller for the deal to make sense for me. The seller trusts me and is willing to be creative with me, however everything I’ve thought of gets shut down by the pre qualification specialist.

@Tashfeen Islam what side of town is it on? 650 seems very fair for Killeen so I’m interested why you’re not getting as many candidates as you’d like assuming you’ve posted on all the sites Craigslist,Zillow ,trulia etc..

I have used erentpayment for a few years now and I like the dashboard and flexibility of it. I just don’t like that it takes so long for them to draft the money out of the tenants accounts and into mine. About 5 to 7 business days.

Hey Frederico, I still consider myself a newb but I do own a rental property in Killeen(43 area). Killeen is a different city compared to all the others in the central texas area. It seems like an ever changing melting pot of cultures and races. Rarely do i meet people in Killeen that are actually from Killeen, or Texas even. There are definitely parts of Killeen that i would not invest or go to for any reason, but there are obviously parts that I would just like any other city. There are people that really love killeen. Especially if they are from a bigger city out of state, Killeen is quiet to them. I feel if you stay out of the "war zone" areas, unless thats what you are targeting, and just create a good quality home for people to feel safe and comfortable, followed by good tenant screening and integrity in everything you do as a landlord, you will be ok. I will buy another property there. Im glad you are taking action and letting nothing stop you. The population keeps going up there and and people always need a place to live. These are just my views and opinions from living there for 5 years and growing up in central Texas. I am not the most analytical person by far I just wanted to comment and show support for you. I think you are spot on with what to look for in a good/bad neighborhood. I would just add a few things that I personally do. 1. Actually knock on the neighbors doors and let them know you are interested in moving to the neighborhood. Ask them how they like it and just hold a conversation with them. This gives you a chance to feel out your potential new neighbors and get their perspective on the neighborhood. It might make you a little uncomfortable, but I'd rather have a moment of being uncomfortable than move my kids into a bad area. 2. Ride the neighborhood late at night, especially on weekend nights.

I have 3 adult non family members wanting to rent a home from me. Do all of them have to be as equal on the lease or can only one of them hold the lease and others be listed as occupants maybe? I ran backgrounds on all of them. Thanks for the advice.
