The reason shes paying without living there... Good Question. Her and her daughter are currently living in seperate homes. Our property is well above standard but, the rent is only slightly above market rent. You just cant find homes for rent like ours. There were multiple people interested within the first 10days; they were all ready to move quickly and when this particular tenant said that their other leases would require 60-90 terminations. I said, "we are looking for a tenant that is able to begin sooner not later than January."🤷‍♀️ They stated that they would be willing to start the lease earlier because they were in the position to do so. They showed us financials bringing in over 20k a month between the pair of them.... So we figured they are good.They paid their security deposit and then the first months rent on time, no problem. Then this month she requested additional time because she had over spent and was concerned about NSFs- there is a late fee if paid past the 13th but, we told her it would be fine to pay us on Saturday the16th we would waive it; per her request ...moving frwd the late fee would be enforced. Her behavior has been strange... she would normally call and this time had texted... and its the use of the word inhabitable, and all the excuses and yet still not addressing her rent... that has me feeling like I would rather not give her the opportunity to move in. Does that complicate it more?

Tenant... signed lease in December paid deposit. Lease began in January. She has not taken possession of the home. We were supposed to have her walk thru today and she was a nocall/no show. Instead she sent us a text stating that the home was uninhabitable. She stated that she had to cancel her moving truck. Her daughter would not be back in town till next week and we need to meet and go over our contractual obligations to each other when her daughter returns. Originally, they stated they would not be moving in till April. Telling us multiple times to take our time... The home is in immaculate condition. There were still a few small items to check off the list but, nothing that would prevent her from moving in or paying rent on time. What is the easiest way to dissolve this lease? What kind of legal consequences might I have to face?

He’s been doing our taxes since 2013 I believe. We’ve owned one of the home since 2013 but lived in it till 10/2018 didn’t convert it to a rental until last month of 2019 and the other we purchased in 08 of 2018 and converted it to a rental last month of 2019. Thats why I thought we would have loss’s to claim on them. Both homes are generating income now but for a long time we were just paying mortgages getting them updated... it was like we knew we wanted to get them onto the market but we were so busy as Realtors and U was home schooling out four kids... we dragged our feet.

*Previous issue—- found that my new tenants had an animal (being kept in deplorable conditions) and several unapproved occupants living in my home. Rent was paid to me on time but excessive wear and tear to the floors (carpets ruined and grout lines black!)

plus deplorable conditions.... communication broke down... Section 8 advised us that our only course was to send the tenant a 7 day eviction notice along with an amendatory clause advising how she could resolve the issues.

Sent the form yesterday. Tenants have not signed. Should I wait the 7 days and follow up with an eviction or Should I contact her caseworker to ask if she can act as an neutral party/enforcer?

Recently filed... I have three Luxury rental properties that we’ve paid roughly 30k in interest and another 24k in taxes on... my tax guy said he didn’t need the statements because it no longer makes a difference for deductions.... does this sound right? I don’t know anything about filing taxes I’ve always used a professionals services...

Hi Patty, Your advise was very appreciated. It really allowed me to feel in control during my next interaction with the tenants. My husband was annoyed to the 9th degree and raised his voice a few times after they said certain things. I spoke with the landlord liason today before speaking with the tenant. I advised her that the tenant had already violated a few terms on her lease(didn't get specific) and we're trying to work with them to correct the matter. I asked her; If we could not harmonize with the tenant... would it be possible to break this lease early. She would not even entertain my question.., she just kept stating-"you should work it out with the tenant..." I asked her if an addendum was permitted holding the tenant financially responsible for the repairs and on going floor maintenance... She advised that, that was acceptable. She recommended creating an addendum that makes them financially responsible for a monthly floor cleaning service. 

The conversation with the tenants did not go so well. They were being very slippery, deflecting and playing the guilt card, something heavy. My husband was very insulted by their responses. Also, I'm pretty sure they were insulted by his as well. They told us that the other people would be out in 34 days. They said that they were not trying to be malicious. we advised them of the dryer vent and AC maintenance and how those were additional cost to us and that we were going to have to now create an addendum to address the violations ( they were so busy rebutting me ; I'm not sure they got my point... the notice will clear it up.) They felt the remedy was that we could pop up at anytime, and she would clean the floors get down and "scrub on her knees (all dramatic)",,, she said no one had ever told her that the floor needed to be more than mopped...so she is not willing to pay for the service and would rather clean them herself. I don't even understand how you could make white grout lines turn black in just 3 months time! We are thinking- send them the written notice concerning the violations( per your suggestion) as well as required remedies and an addendum that addresses the on going floor cleaning services. If they don't comply we will pursue eviction at that point.  Also, when you stated "Only problem is, you’ll have to deduct your share based on the remaining lifespan"... I'm not sure what that line means.... would you mind elaborating?

For us rental values have sunk and we thought it could be a win for us and them- a fantastic opportunity to provide a family in need with above average housing while also being able to make sufficient ROI that is seemingly recession proof. If they were cleanly and didn't turn my home into a hotel... it could have been fantastic. Rates have gun down since I purchased it... We put down 20% and we've gained maybe 10% equity. I'll probably cash out refi and then consider my other options for this property. 🤷🏻‍♀️

Scary, You are a freaking Psychic! Your words have already rang true! It’s her, and her 8 children that are covered by the voucher. Now it’s her friend, her fiancé, his brother and her friends kid! They were trying to get us to accept cash app or Venmo for their portion but, it was under the guise of convenience; so we wouldn’t come by the home. If I say, “look we( my husband and I) talked about it- weighed our options- discussed the potential outcomes if we made a formal complaint with the liaison... this just isn’t working out... if you guys leave now on your own at least you can keep your section 8. If she says, “ but we will have no place to go”... how would you recommend that we respond to that ?

@Caleb Heimsoth- I was praying that it was a myth. I have another even more expensive 1/2 Mill home with a Section 8 tenant in it that is phenomal. No complaints, very clean, very appreciative: ask if their wealthy family member paid could they add an underground pool to the home. So I guess it’s mostly my fault for not doing enough due diligence with this one. You live , You learn

@Lynnette E. That’s a really good idea seeing that she will be getting her taxes soon. Maybe we could save the floors if we could figure out an affordable way to change the grout back to white. I priced out pressure steam cleaning them and they wanted $2 a sqft there about 1500 sqft of time???Its supposed to be white.
