Rick Harmon I'm going stick with this one and see where it goes. The family doesn't seem to know what to do with the home and was content to let the foreclosure complete. I guess my talking points with a probate attorney would be to determine if probate has to be opened in order for the children to sell to me. I'm afraid they'll say yes, just to collect a fee, like some bankruptcy lawyers in town will do.
Coincidentally, I lost out on another probate prospect today. The heir opened probate bc their extended family is kicking them out of the house. It's also in foreclosure, so I dropped off an option to purchase to their attorney last week. Today the attorney called and said they're mailing it back to me bc they don't do options. I said I'll drop off the purchase agreement and they declined. Interesting....

Today I made contact with one of the heirs. They advised that the deceased mother had a large amount of medical bills and that the children didn't have an interest in the property. When I checked for liens at the courthouse, there was only one lien for $6k for two med bills combined. If there are more med bills unpaid that are not liens, should I continue with pursuing this house? Is it worth it to talk to a probate attorney?

Ibrahim S So would you talk to the heirs and execute a purchase agreement with all of them first contingent on clear title and completion of probate?

Hi Sharon, I went to the probate court first to see if they opened a case. Then I knocked on the neighbors door, and they gave lots of info. The kids of the deceased had to strip a lot of stuff from the home to pay for the funeral, and the neighbor indicated the kids were just doing to let the bank foreclose due to outstanding liens. I checked the liens filed against the property, and they total about $20k including the mortgage.

Hello BP,
I have found a house that has a small mortgage against it and a medical lien. I'd like to purchase the house and payoff both liens since the lender is foreclosing. However, there hasn't been a probate case started. Can I still contact the heirs and purchase directly from them or does a probate case need to started? Any helps would be great, thanks!
