Post: No Deed/Title after Foreclosure and Chapter 7?

My direct marketing led me to a homeowner with the following situation:

He went through a foreclosure several years ago; to which he thought he lost the home, and then it sat vacant for four years. He apparently still owned the home and paid off some of the back taxes according to him. He then went through a chapter 7 bankruptcy which was delayed 3 times because they could not track the deed down. He said it went through but he is still on the county record as the owner and owes about 16K in back taxes and is getting hit with code violations. Is there any chance he can still own the property free and clear? That's what he says but without title he can't sell. he wants out- does anyone see a path to a solution here?  I am not sure if a title co will run a search or agree to do it without a fee? Any advice on where to start is appreciated:)

@Grant Kemp great story. I really loved your podcast as well. i did not realize your niche existed. I have been on the site for about six months working on marketing to sellers in Wisconsin without too much luck. I like the success stories like yours because they keep my eye on the goal and off the temporary setbacks.

Hey Charles,

Yes you should bring it to the title company right away if you have not already. I talked with the title company i plan on using ahead of time and usually you can have them fax it direct to them, or if you have it you can take it there. I think it also needs to get recorded at the county real property office too in case they try to back out of the deal, although if you are using a title co. then i think they take care of that.

@Casey Peterson There is not one I am aware of other than Wausau. In Eau Claire we have had an informal group of BP members meet and scheduled it once a month. They just had a meeting a few days ago i was not able to attend and I am sure plan to have another next month. I don't think we want a group with fees like an REIA yet, but maybe in the future. You are welcome to come to our next meeting in June. i do not have the date/time yet but can get that to you when I know. Send me a colleague request so I have your contact info.

@Casey Peterson Welcome to BP. I love the La Crosse area and like to visit there. I am a recent Newbie as well.

Try setting up some keyword alerts on topics that interest you, that has helped me learn about those topics very quickly by reading posts of issues REI people are dealing with.

I am free most weeknights after 7 other than tuesday. Anywhere that has coffee I am game. There is a place called Camille's near my side of town (northeast) that has lots of meeting space.
