I run a small PM business in Milwaukee and I think you are over thinking this a bit. There should be no issue with or your husband filing the eviction for your father in law. You can always have an attorney do it for you. Charge for that including filing fee should be about $3-400. That will take all the headache and emotion out of going to court. Send the 5 day notice via certified mail so the tenant can't play the game that they didn't receive it. You will have to fill out an affidavit of non military service and affidavit of service then you are set to file or have your attorney file. Court date will happen in 1-2 weeks then you get the writ of restitution. If they don't leave by the time the court says then you will have to hire the sheriff. I do on average of one eviction a month and have never hired the sheriff. If you don't think they will leave on there own, tell them you will put a judgement on them for all rent and damages then garnish there wages. This is usually a good enough empty threat to get people out.

Is it a month to month lease? If so, give them a 30 day notice to vacate. It's not an eviction. You are just terminating the tenancy. You don't have to give a reason why just like a tenant doesn't have to give you a reason. Explain If they don't leave after the 30 days then they will be evicted and break down how bad that would be for them. Harder to rent a new place, judgement for money, wages garnished.....

I charge a $500 sublet fee and the tenant is still responsible for the rent until a new tenant is secure. I do all the advertising and showings and only allow the current tenant to offer referrals.

@Garnett Broy My buddy lives in Wicker Park and I just helped him get his first investment property in Milwaukee. He's in the same boat where it makes more sense for him to keep renting in Chicago and buying rentals in MKE. If you are looking to put $10K down, I would suggest looking for Duplexes in borderline neighborhoods for $50-70. You should be able to find a fully occupied Duplex that is getting about $1200 in rents and needs minimal work. Let me know if you want to talk about neighborhoods in more depth.

Hi,
The City of Milwaukee is requiring me to use an Engineer or Architect for an issue with the facade of two story brick building in Milwaukee. Does anyone have a recommendation of someone that is reasonably priced and can assist in getting the city off my back?

I have never used crime date to evaluate a property or the neighborhood. Milwaukee is so block by block that I don't think data from a website can give you the information you need to decide. If tenants are questioning a neighborhood, I always recommend them to drive around at different times of the day and see what they think for themselves. As an investor it is also good to drive by and walk the neighborhood at different times of day so you can get a feel for it. I look for the follow when I decide on an area. How many people seem to be just hanging out? How many lawns aren't cut? What condition are the other properties in? What condition are the cars in? If I don't feel comfortable going to a property, I won't buy it for myself or manage it for someone else.
I've worked with some out of state investors and its hard to describe but there are some great pockets in the city that crime data would tell you to run from. Get out and drive around is my advice.
