I don't know, if this is in the Pine Hills area you may just find a buyer without going through that trouble, ha ha. However if you are going to re-hab anyway then yes take it down.

Hi Mike,

You should listen to Ophelia and Andrew. Let the seller know that you will be there for them if they need you again. Let them know they may face the same situation with the new investor and that you are closer than anyone to closing the deal. Be as compassionate as possible, and do not cause them extra stress. Chances are they will realize you have their best interest at heart and stick with you.

I agree with Jacob, verify that you are dealing with an actual attorney. Also check court records to see if any law suit is being pursued.

There are some cases being pursued from original homeowners due to the "Robo Signings", however most of those have lost the property and are seeking a monetary compensation, not to get the home back.

If I am dealing with a homeowner I almost never put down more than $10.

Any amount of money will give you interest in the property, even one dollar. Only when using a Realtor do I use $1000 or more.

I really appreciate everyone's input. Here is what happened. I manage a Process Serving company, and someone called asking if we provided the service. I know I've seen other companies advertize this service but did not know if I wanted to get into this. I have the experience for it.

Again thank you I have an idea what is involved and what to charge.

Has anyone ever used a company to attend foreclosure sales and bid on their behalf? If so what were the fees for this service? What ground rules are normal?

That is hitting the nail on the head Jon. And before anyone makes the suggestion of using Transactional Funding (not that it would even fit this scenario), it also is financing. Cash is just that, cash.

I did ask the investigator for the Statute(s) and or Rule(s) that required the filing of the contract. His reply was a PDF attachment of the definitions of Florida Chapter 475 and the exclusions for a license. Along with this was a copy of thier website (please see Bryan's comment with the link,DBPR, and click on "Services that require a license" once you are there).

There is no mention of equtable interest or anything close.

Maybe this is what they are looking at. I wonder if a Notice of Option will suffice. I will keep looking.

RECORD OF CONVEYANCES OF REAL ESTATE View Entire Chapter

695.01Conveyances to be recorded.
—(1)No conveyance, transfer, or mortgage of real property, or of any interest therein, nor any lease for a term of 1 year or longer, shall be good and effectual in law or equity against creditors or subsequent purchasers for a valuable consideration and without notice, unless the same be recorded according to law; nor shall any such instrument made or executed by virtue of any power of attorney be good or effectual in law or in equity against creditors or subsequent purchasers for a valuable consideration and without notice unless the power of attorney be recorded before the accruing of the right of such creditor or subsequent purchaser.

(2)Grantees by quitclaim, heretofore or hereafter made, shall be deemed and held to be bona fide purchasers without notice within the meaning of the recording acts.

I just did not want to rock the boat with the investigator, but you are right I need to do this.

A Broker, not even from my own county, filed a complaint and the investigator had to follow up. He actually gave me information on how to get by without having a license, one bit being in my previous post.

I will see what I can find out, I don't want anyone else to have to go through this.
