Post: Not using a Qualified Intermediary in a 1031 Exchanges

I have recently come across a situation in which someone sold their investment property and didn't follow all of the 1031 exchange procedures completely ( they received the funds directly after selling their investment property instead of depositing the funds at a Qualified Intermediary). They have spent a portion of the funds they received which makes me believe they are no longer eligible to participate in the 1031 exchange and will have to pay taxes on the gains, are there any alternative options to defer taxation?

I wanted to reach out to the BiggerPockets community to gain additional knowledge as to what the major differences are between a master lease and carrying the note outright in both the seller and buyer's positions. If you could provide the pros and cons I would greatly appreciate it as I have a basic understanding of the two strategies.

I'm just starting to get into the direct mail campaign and was wondering how much you should spend on an average lead? Any suggestions of places to go to buy lists would also be greatly appreciated, thank you.

I think this is best to consult with your local contractors because everything  can theoretically be fixed it's just going to cost a lot to fix some.

I think this is a great idea, except it would be hard to monitor the tenants actually doing what they say they did plus it might be worth not having them mess around with your 4K investment.

Having an LLC purchase a property tends to require a large down payment so if you're going the low down payment route this might not be the best option. LLC's are incredibly important due to the vial of protection they offer investors so you should consider every outcome in your decision making.

Each investor has their own criteria but the stock market offers 8-12% historically and incredibly liquid whereas real estate isn't liquid therefore, you should require more of a return than the stock market.

Work on your reputation first and then when you have more experience under your belt and can provide investors with historical financials, work on syndicating deals. Investors will have more faith in you when you do this because doing a couple flips isn't the same as doing a couple hundred or even owning a 100+ unit complex.

I think it is best for you to focus on improving both the rent roll and appearance of the property, new buyers might be interested in house hacking it like yourself and they will be incited by the higher rents. In addition the more appealing the property looks the more people will want to rent and own the property, just don't invest too much into to it that you won't recoup those costs. good luck!
