I have USAA and they insist on replacement value, which protects the insured.

Looks like the inside trim is also affected?  I've seen this with moisture damage to the wood.  What's just above that door frame?

I get charged a one time leasing fee when we get a new tenant, but it's not a whole month's rent.  I also get charged the usual monthly PM fee percentage.  When I was interviewing PM's, they all do this.

I usually pick and choose the best clauses out of several contracts and make up my own.

Would you be able to bill her for the services?  She may be correct that your are responsible to cut the grass, but who will pay for it?  Just reaching here!

If it's in primer now, ask what color he intends to paint.  They may not have liked the orange, and as you said, you would have done it a few shades lighter yourself.  So I think it's a win-win situation.  They'll probably go with a neutral color.

If you see a black light laying around, he'll be painting it black...just sayin'.

How long has been working under your ownership? 

Does he have a signed contract with you?

Independent contractors like he insisted he is have to carry their own workers comp.

Make sure to send him his 1099 at the end of the year.

Get an attorney to counsel you on this.  Show him your interactions with this guy that you documented in a staff file with all the above info.

Good luck.  I'm not an attorney so not sure if this guy can win with pre-existing medical problems.

Standard I see is in my location, which I believe is pretty standard nationwide, is 7%-10%, depending on number of units and neighborhood.

I think many do this.  From what my realtor told me, an offer is made, and when you're in contract, that is when they have to cough up all the requested documents for inspection and you have the option to move ahead with it, or move on.  The price can be renegotiated accordingly.

Sounds like the one I got from Real Property Management franchise.  I lined out everything I wanted struck from the contract and the PM sent me an updated one with the certain language gone.  You don't have to accept the contract as is.  You can ask to change it or choose to go elsewhere.  I asked for other PM company contracts as well for comparison, and most have similar language though.
