There is a NC form that demands the buyer present EMD within 24 hours or the contract is cancelled. If your agent is not responsive - talk to their Broker-in-Charge and ask for another agent or to be released from their contract for their non-response. I am a BIC and I know the challenges of dual agency. Cancel the listing and move on.

I specialize in Gastonia and own 40+ rentals there.  From my perspective - there is no bad part of Gastonia - there are areas better than other but no significant crime I see.  Many of my rentals are the southwest portion.  Gastonia is growing strong - even old neighborhoods have new homes being built!

I recommend Surane Law.  They are knowledgeable about Mecklenburg courts embracing Legal Aid to help tenants (plus their counter suits against landlords).  You can start the process at

I facilitate local investor meetups in Charlotte NC.  We frequently get new investors who are looking for owner financed, subject-to, and lease option deals.

These normally DO NOT EXIST.  Every seller understands cash....

Creative Finance deals are developed through an education process to solve a problem for a Seller (and for you as a Buyer).

Yes - some wholesalers develop these opportunities and assign their contract - but they are better off finding a way to stay in these deals.  

Fact - most Sellers may not accept your proposal to owner finance or other creative financing model - but it only takes a few of these deals to kickstart your progress.  Don't get discouraged - it may take 20 offers to get one.  Focus on tired landlords and properties needing work.  Develop rapport with Sellers to improve your success.

Consider making 3 offers - 100% owner finance, 90% owner finance, and cash.  Your cash offer would be the lowest total price offered.  For example - a house rented or would rent for $1000/month - offer $90k if financed with no money down, $70k with $5k down, and $55k cash.  Don't get caught up in interest rates offered to the Seller.  Make sure you have good positive cashflow - $200/month minimum. (If these $ don't work in your geography - live where you want - but invest where it makes financial sense.  This strategy works in some Charlotte suburbs but not likely in Charlotte NC city).  Use an investor knowledgeable attorney or title company to prepare the financing paperwork.

Real Estate is not all about houses, multifamily, land, deeds, etc.  Real Estate is primarily a People Business !!

Attorney James Surane was at a local REI meetup and discussed these situations. The City of Charlotte granted Legal Aid $800,000 to assist in local evictions. This is primarily an issue only with Mecklenburg County evictions, not statewide. Surane Law (James Surane is a former eviction magistrate and now runs a local firm focusing on assisting landlords with evictions) advised that the exact problems you are seeing are being used by Legal Aid.

I recommend that Mecklenburg County landlords use Surane or other attorney that are used to dealing with Legal Aid.  Legal Aid is fierce - I recommend you tread with CAUTION.  This is one reason I don't have rentals in Mecklenburg County but in neighboring counties - better returns as well plus strong tenant demand.

Surane has a very strong lease that he can provide as well.

With the current economic climate - I would be careful - and I am a bullish investor.  This sounds like a silent partnership.  Red flags.  I recommend instead providing a loan secured by a DoT (mortgage) where you are first in line to get your money.  If they have a hard money loan already then you are in second position (don't do it).  Many can promise until you lose money.
