@Sean Morrison, Thank you Sean! Appreciate the response and the helpful info. I love where I live, but this is going to get real pricey real quick lol! Hopefully it won't eat into my REI income/cash flow.

@Kelly Rastatter  Thank you Kelly!  Looking up Mark now.  Yes, I have a wholesaler contacts in Nashville that I am going to be working with, however for buy and holds I am more attracted to Clarksville, Chattanooga, and Knoxville! :)

Hello BP Family, 

I have more questions for you!  I am currently a Los Angeles resident looking to invest in real estate in TN. My plan is eventually to acquire buy and hold properties in or around Nashville, Clarksville, Knoxville or Chattanooga, but my first step will most likely be to wholesale properties (outside Nashville, TN area). With my long-term and short-term goals in mind, I am trying to first identify a real estate attorney that is licensed to practice in both California and Tennessee, and second, determine if there are any legal implications to my plan I should consider. 

Here are some specific questions:

  • In TN, is it more advisable to assign contracts from your personal name or an entity? I read somewhere that if you have an entity then you may also need your realtor license, which I do not have and do not want. :)
  • If LLC is preferred, should I open a CA LLC and apply as a foreign business in TN, OR should I open a Wyoming or Delaware entity for anonymity?
  • Will I need separate LLCs for my wholesaling and for my buy and holds?  This is going to be very pricey considering I will still have to pay CA fees even if I operate elsewhere.  I am just starting out so my capital is limited.
  • Anything I should consider as a California resident assigning contracts in TN?

I also need a lawyer that can help me draft contracts/agreements for purchases, assignments, seller financing, subject tos, and rentals.

Hi Caprice! I am a fellow newbie investor in Los Angeles. I plan to wholesale (and later invest) in TN to build capital, learn my market, and to become a pro at finding off market deals for my future buy and hold endeavors. I don't have much to add here except to say that there are tons of LA REI meetings that are connecting over Zoom. Do a search on meetup.com for Los Angeles Real Estate and I think you will find what you are looking for. There are also tons of facebook groups that are extremely helpful. Great questions by the way...I am following this thread so I can benefit from any answers you may receive. ;) Good Luck!

Thanks for the reply Tyler.  I still haven't purchased my first investment property even though I posted this 8 months ago.  That'a a nice little reminder that I need to get going!  I've been researching and in an education phase and have learned soooo much.

You are now located on my side of the country!  I am hoping for the same thing in terms of deals opening up.  If you end up replying 8 months from now, I better have a few properties under my belt or I am going to be very mad at myself.  Good luck with everything!
