For example, he's at work at the moment.

The girlfriend's car is there and she just uses the place to herself on the weekend. Without discussing or letting us know as we agreed before the addendum.

Also, is the camera legal?

We're in Massachusetts and there's a 2 way privacy law which forbids cameras if the other party doesn't consent. I don't know if there's a workaround.

"Second week before moving in"? Did you give him keys two weeks early?

A good lease will set limits on how many days a guest may stay. Mine says no more than 8 days a month (four weekends). If they are there long than that, they are no longer a guest and need to be screened and added to the lease.

"Dear Tenant,

We can hear that someone else is living with you regularly. Our policy is that all occupants be screened and approved. Please have the other occupant submit an application no later than [DATE] so they can be screened. Once approved, we will have her name added to the lease. If you fail to comply, we will have to terminate your lease."

What happens if they get serious and have kids? You can't discriminate against people with children. Besides, a pregnancy is nine months, then it's another year before it starts to toddle. Why does it matter that it's an old house?
He moved in. Within 2 weeks he made copies to his place. We know because he's often at work, and we hear her opening and coming in with the keys. Tried to play it off as the cleaning lady.

He assumes we don't know she has a set of keys even now to the unit.

this isn't a tenant who is upfront. He's also damaged our walls upon moving in and says nothing. We just let it slide that time.

As for the kids, I would imagine that this is his long-term gf. House is old and lead, etc is unknown.

Is there way to check for the guest policy in Massachusetts?

Google is drawing up different opinions but nothing concrete.

So an update. I spoke with the tenant and he tried to deny the issue. Claims that she was only there on the weekend. We know she's there on the weekdays.

also says he met the girl 3 weeks ago.

I prssed and he claims it was Spring Break. Clearly, he's not the honest type. I asked him to comply with modifying the TAW agreement with a guest policy and inform us if he has people over, and he agreed. He gave an attitude.

just saw her staying at the place again before we even drafted the new addendum.

As for the keys, he made a copy and for her 2 weeks after moving in. We know because we reside downstairs in the first unit in the multi.


This guy is just playing games at this point.

She seems to have moved herself in since Feb. And have been sneaking out early morning/late night.

We hear her when he's at work. We live downstairs and he's made no attempt to be transparent.


Are there any rules for tenant guests in MA, and what happens if they are serious or decide to have kids (in an old house)?
 

Pat, thanks for the advice. Ran it over with the "wife" and it was a no go.

There's that. Good to know, since not being an expert on cars, I'd expect some type of hazard to come up during the actual work.

Hi All,

So I'm renting out the garage on a multi I own in MA to maximize my cashflow. 

Already have a lease printed out that, should the renter sign, has a clause in there that says we're not liable for anything missing from the site. We have a renter who is interested in grabbing the space for car restoration.

I was told I need liability if they are doing restoration of any kind. Is this true, and how can I protect myself from any liability should it arise?

Either in this case or otherwise.

@Mike Hurney hmmmm...I can tell ya I'm not holding my breath for Quincy. I'll be speaking with 2 agents this weekend, and possibly include Brockton on the list.

@Shaun Reilly Thanks for the greeting. I agree, there's a ton of good content to learn from at BP, and the amount of material and potential contacts is what initially drew me to the site. Markets are dynamic, and having a central hub to get the latest insight is almost a necessity. As far as the pre-approval, we're actually all set - though I share your opinion on banks.
