Hi BP,


A group of people I know recently asked if they can lend me money on my next project but I haven't accepted private funding for my projects up to this point of my investment career. I was wondering what is the legal way to broadcast, collect and guaranteed (using a deed of trust) for the private money? 

This is a real estate flip project.

@Dave Foster Wow, that was a great response. I definitely got all the answers I needed in that one post. An large multifamily opportunity came my way that I couldn't refused. I knew that I would only rather have one or the other, 16 units or 50+ units, right now I am definitely exploring the options.

Hello BP,

I am new to the concept of the 1031 exchange. I owned one of my rental building for more than 2 years and another one for 3 months, I am wondering how soon could I start the 1031 process for them. Thanks BP!

Forming the LLC is the easy part. The next step is to hire an attorney to draft an operating agreement between you and your partner(s) that highlights buyout clauses, decision making (in case of a tie breaker), etc. Huge advantage of this would be protecting you and your partner just incase the deal goes salty in the future, just a precaution.

This is just more tools in the toolbox for you but be careful that when you are a license agent in California, there might be some legality issues if you continue and/or start work as a wholesaler.

Investing out of state is definitely possible but it will take some homework upfront. 1. Do you have a realtor you can trust in that area? 2. Have you done your homework on the local property management companies? (what is their reputation, cost, plans for getting your place rented and up to market rents) 3. How is the job market and population growth? 4. crime rates and school systems? 5. How are the property taxes, HOA and maintenance fees? If you understand the fundamentals and have a strong team in place investing any place with cash flow will now make sense for you.
