My major concern was that even though the loan contingency has been removed, shouldn't the due diligence been done long before this point? Are there any repurcussions towards  the financial institution? I appreciate your insight, Thanks again!

The tenants are not aware that the owner wants to move in and I do believe that the underwriter wants a "owner move in" notice.

Currently in Escrow to sell my Oakland duplex. The buyer is looking to move into one unit and his family into the other. This is an FHA loan and we are now past the 40 day mark and all contingencies have been removed.

On the day before we are due to close the underwriter wants a guarantee that the tenants will be vacated in 60 days. Considering the rent control laws, I myself cannot issue the owner move in notice because I am not the one who wants to move in. The buyer can't issue any notice because he is not on title. Any advice/experience with an issue like this?

It makes more sense if you take it up to the ceiling. If you don't it will look inconsistent. If possible you should post some pictures to get a better visualization.

You can use a private/hard money lender. They typically do not use your credit but they do cost you a lot. I suggest looking more into this route if you don't want to depend on your credit report.
