Hello BP. I have neighbors telling me that there has been some drug activity with some of my tenants that live upstairs. I'm here in Massachusetts and I've heard rumors that evictions are on hold is this true? I need to get them out and I want to try cash for keys first but if that doesn't work I'm going to have to do a formal eviction.

Hello Brendan, My name is Peter and I have done exactly what you are talking about. I'm about to turn 24 and I bought my first house a year, and a half ago. It's a 3 family where I live in one and rent the other 2. So far it has worked out really, really well.

Hello BP Im a new landlord here in Massachusetts, and im getting my lease together using the lease that comes with the pro membership ( I just upgraded and I love it. highly recomended) there is one section 19 B that says 

(B) Landlord, in its sole discretion and for its sole benefit, shall cause the Premises to be insured as it deems appropriate. Tenant shall have no right or claim to any insurance or insurance proceeds of Landlord. Tenant understands and agrees that Landlord has no obligation to obtain insurance for Tenant including, but not limited to, liability, hazard, or contents insurance. Tenant shall, at Tenant’s sole cost and expense, obtain renter’s insurance covering the full value of all personal property of Tenant in the Premises, and providing liability coverage to Tenant in an amount not less than $_________, which policy shall name Landlord as an additional insured. Tenant shall maintain such renter’s insurance at all times during the Term of the Lease. Tenant shall provide a certificate of insurance to Landlord demonstrating that Tenant has procured the required insurance coverage, within ten (10) days after the commencement of the Term of this Lease and within ten (10) days after any renewal or change in such insurance coverage. If Tenant fails to procure the required insurance, allows such insurance to be cancelled or to lapse, or fails to timely provide the required certificates of insurance, the same shall be a Default of this Lease

This is requiring the Tennant to have renters insurance, should you force all of your tenants to have renters insurance? how much coverage should be the minimum? and lastly what if the Tennant doesn't want to have renters insurance? should you loose a perfectly good qualified Tennant over it? any input would be greatly appreciated.

@Bryan Payne Hello Bryan my name is Peter, and I'm in the same situation. I have one 3 family in Lancaster MA and I would love to get a second one. If you occupy the property you should be able to vo with a 5, or even 3.5% down payment.

First and foremost, Section 8 is a protected class in Massachusetts, so you can not discriminate against any tenant that has it.

As for the steps.

1. list and show the unit as usual.
2. validate all tenants the same way.
3. if you go with a section 8 tenant, then they will have paperwork for you to complete/submit.
4. section 8 will send out an inspector to check the unit, all common areas, the exterior and the basement (does not matter if they have access to it or not).
5. They will check for everything to ensure safety and habitable. i.e. doors/locks, lights, detectors, windows/screens, appliances (stove with anti-tip plate), hand rails, wiring in the unit and in the basement, lead paint (if children).....etc
6. Then the inspector will provide a pass or a list of items that you need to repair.
7. the inspector will decide what the rental rate will be for your unit.  There is guideline by section 8, but the inspector sets the rate. 
8. Every year they will perform another evaluation to ensure you and the tenant complies.

Hello rich why would the inspector decide the rental rate I feel like that should be up to us to get the fair market rate

Make sure they understand the process. Or, they could even apply at the apartment with a laptop if you have one. Also make sure you advertise the requirements so that you don't do showings to people that don't qualify.

hello Sandy its a 4 bedroom 1.5 bathroom unit with the heat, and hot water included. im asking $2,000

Hello BP I have an empty unit that I have been showing. I have a lot of interest in it, I've had about 20 people come and look at it but no one is committed to getting it. im telling them that they need to do a credit report and a background check through cozy at a cost of $40 that I will take off of the first months rent. this is not working... what do you have prospective tenants do for an application, and does cozy work for you

@James Wise 0k thanks for the advice when this covid-19 thing blows over I'll probably evict them.
