Jay, my brother is is real estate development and between us both, below are some of my favorite lease clauses.  Hope this helps

  • 1.This security deposit is not to be used to pay the final month’s rent.Initial _____.
  • 2.Tenant acknowledges that there is no smoking permitted indoors. Subject to inspection and a per incidence fine of $100. Intials: _______
  • 3.COSTS AND ATTORNEY FEES: Tenant(s) shall pay the actual amount of all reasonable costs and attorney’s fees incurred by Landlord in connection with successful action to enforce the Landlord’s rights under this agreement.Intials: _______
  • 4.While in possession Tenant is responsible for maintaining the dwelling, kitchen and bathrooms, including free flowing drainage of all sinks tubs and showers.Intials: _______
  • 5.Tenant will be responsible for replacing batteries during their tenancy and if removed by tenant will agree to replace all missing smoke detectors. Initial ____.
  • 6.Severability. The invalidity or unenforceability of any provisions of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.

 Chris, I have a question about Smartmove that I'm trying to get answered.  If you have 3 applicants, like this forum post says and you use smartmove.  And for this example, One is rejected and 2 are accepted, you pick the best one for your rental but do you have to refund the other's application fee that was also accepted?  Please advise and thanks for your help,

This has been posted but is so good, in my opinion its worth repeating.  Never be the owner to your tenants, be the property manager.  It allows you to play good cop bad cop and if you are like many of us, sometimes too nice for their own good when it comes to business anyway, this allows you to get out of uncomfortable situations like late rent.  You get the call with the sob story and it doesn't always fall on your shoulders.  You can say "I would love to help you but you know the owner is a hard *** and doesn't allow late rent."  I love this and use it when I need too, hope this helps
