@Tina Lee You should send the 90 days notice now. That behavior likely won't change so don't renew and continue this mental torment. Also consider signing up for a tenant management portal like Apartments.com that automates the late fee charge and also provides recurring payment options. Also note that maybe giving more options to pay might alleviate the issue.

I would explain that fact to the tenant plus the fact that an eviction was filed whether they leave or not will end up on their record. For some people the fact that any sort of eviction filing would be on their record even if it never gets to the actual court date might be enough to get them to pay that lasts months rent.

See above. There is no security deposit to hold.

The energy cost spike has got me thinking about energy upgrades in my property and I came across the EmPower and Home Assist programs. Has anyone had experience getting these or any state financing on upgrades? There's Vet and retired residents that likely meet income requirements. Curious if the benefits outweigh hassle of applying and what type of work you were able to get covered.

If you're a landlord in NY, you know you are only allowed to collect 1 months rent as security deposit. On 2 occasions now, I've had people move out and not pay last month's rent and expecting (with my express disapproval) of applying security. So what remedies do you use to protect your interests? It's not productive to fight for damage reimbursement in Small Claims court and at the same time no way to stop somebody from not paying last month's rent when they given Non Renewal notice. And not a coincidence that the people that do damage the property are usually the offenders. This is such a landlord hostile law. Anyone has any workarounds or tips?

 If the lease expired, you can evict even if payments are up to date. Make sure you serve the 90 days notice properly then once the 90 days lapse, stop accepting payments and begin eviction.
