Post: Hoarder tenant is physically unable to move his belongings

What would you do? How do I get this tenant out?

Four unit property, with one unit housing an elderly hoarder with a bad back.

His official lease has been done for more than a year, so he's been month-to-month for more than a year now.

The trash pile in his unit makes the halls smell bad, and we need to get in there and renovate the unit. Given his age, he already has trouble going up and down the two-story stairs, so waiting longer would mean the guy would just be further entrenched.

At the end of March I certified-mailed him the Non-renewal notice with a move-out checklist, and regular snail-mailed him the same thing two documents just to be sure. The documents said he has a May 3rd move-out date, more than 30 day notice from March 25th document date.

Called him yesterday to ask when I would get the keys from him and he was unaware of anything because he had not left the apartment in two weeks, and had not even gone to the mailbox. Completely unaware of the non-renewal notice.

Given the guy has mountains of garbage in the unit (never would have been allowed but he was an inherited tenant), and the guy can barely walk around due to a bad back from age/ his work, how would you orchestrate this? He's not capable of moving all that himself, and will just ignore the May 3rd date.

Our current path is to just start the eviction process on May 6th. Do you think we should try to convince the guy to leave by paying for movers?

@Michael Eng  Yes, and I also realized that if you buy in Lackawanna, you get a Lackawanna-type tenant. There are certainly good people in all area codes, which you can find if you screen enough, but buy-n-large you will be dropping by the property in Lackawanna MUCH more often to fix things than if you had bought in a nicer neighborhood. It is Very hard to find a property in Lackawanna where the previous landlord saved up for capital expenses or gave a hoot if a gutter was draining into the house. Have you bought previously in Buffalo?

Hey Loretta, I have had good experience with Novist Property management. Their present portfolio is smaller than most other PM companies in Buffalo, so they are more attentive to their client's properties. I would reach out to @Matthew Mckinivan

Look up Jay Meadows at Indigo Buffalo Electric. He's a by-the-book guy who has done a couple jobs for me with good results.

Michael Eng you could look into the management done by Jacob Lea-Kelly at Beacon Management who manages within the city limits of Buffalo, but you could ask how far away he would look after a property.

Hey Craig, From the contractors I spoke with, I feel the best about E5 contracting. I would recommend them. Again, not the cheapest but Mike at E5 seems to have his head on his shoulders.

One of my coworkers that is an investor there in Niagara Falls just had a squatter tenant, who also stole the appliances in the unit when he left. When mentioned to the police, there was a lackluster response. In other words, many bad tenants and I don't think the authorities there will be going out of their way to help you out. I have yet to hear about a good pocket of houses but it probably exists though. Just my two cents.

You might try Jacob Lea-Kelly for this. If it's in his jurisdiction! Solid property management from what I see
