Chicago Illegal Garden Unit

Currently in the middle of attorney review. Buying a 2 flat with an illegal garden unit. In my letter we've asked that one tenant move out prior to close. They responded the garden unit will be empty. Is it legal (for Chicago) for the owner to occupy the garden unit. It is not zoned as a 3 flat. Currently in the ADU pilot areas if that helps.

 Yes it is legal, but your lender will likely require you to move into a legal unit and not the garden.  After closing you can liver in whatever unit you want
