First eviction
Hi all, I have a question regarding my first eviction in Kansas. Tenant is 25 days late on rent now. I received a bounced check last week and was informed the tenant is in an inpatient rehab. I did however already send a notice stating that the rent was 20 days late due to the insufficient funded check last week. One of their friends contacted myself on their phone saying he wont be out for a while after the certified letter was sent to the house. Their friend also made a threat that if I were to evict that they would stay there for 6 months and not pay a dime. That being said I would love to get the process started ASAP as well as making sure I have covered my bases as well as doing everything in order with the proper paperwork. Any suggestions would be awesome. Thanks everyone!

Whether or not your tenant is in rehab doesn't change the fact that they are behind on their rent. The friend that threatened you is inconsequential. He doesn't matter and you shouldn't even be speaking with him. You should proceed through the proper eviction channels dictated by your state's landlord/tenant laws. Your mortgage company will not allow you to pay your mortgage late because your tenant is in rehab. Rehab or not the rent is due. A family member should step in and help him to keep his apartment. Do you have any contacts you can speak with beyond this "friend" that is clearly an idiot. You should make an attempt to contact a family member to let them know that you are evicting the tenant but don't stop the process if the rent is not paid just because he is in rehab.
