Background checks
Are these regulated by the govt? (I am in Texas)
Can I run one anytime I want? (as long as they sign the consent form)
I bought a duplex where one side already has a tenant.

Be aware there are several kinds of "background checks".
Criminal background check - my experience is these are done statewide and by different companies than credit.
Credit History - like Experian, Trans Union, etc - this is governed by FCRA as @Steve Babiak said. Must have had an office inspection to actually see the credit report.
Eviction History - very local and also done by different companies than credit - These sometimes shows up on credit too if there was a judgment that was reported but usually not.
There are sort of clearing house companies that will do all of the above for you. There are also companies that do just one or two of the above for you. There are internet based companies that do one or more of the above for you. Know what you are purchasing or your screening process might have some holes in it.
