Eviction Process in Texas

I am currently going through the process of evicting my tenants, due to them not paying rent. I am out of state and have renters warehouse as my management company. They have been late several months, paying at around the end of the month each time and having to pay the late fee to the property management company. The last payment received was in March and I have not received a payment for April or May. I gave the notice on 1 May. My biggest question is with me still owing a mortgage payment, will they just be living in my property rent free until the court rules? I also haven't received a court date, but the management company says it usually takes up to 60 days. Lastly. my management company is saying my rental default insurance is expired in Jan(12m mark) although the tenant signed a 15 month lease.

    @Timothy Stowes sorry this happened to you. As a property manager in Texas I can speak from experience.

    1) Do not expect to collect from the tenant unpaid rent. 

    2) Texas is very landlord friendly so you should be able to get non-paying tenants out too much effort. Unfortunately, at this time, due to court dates it is taking ~6 weeks to get a tenant out. Start to finish. It has been much shorter in the past. 

    3) The tenant default insurance...Honestly the property manager should have started the eviction when the default insurance was not renewed.

    4) I'm not overly familiar with Renters Warehouse process but we like to offer "cash for keys." Paying the tenant $500 to move now without going through the eviction process is best for both the owner and tenant.
