Could you then rent the house from your IRA?  

(the source of that money is a closed out IRA supposedly)  Show me bank statement that shows it's in her account but not available.

And I think since I have such a little amount it in anyways, I don't see the point of rolling it over to a solo 401k or IRA and trying to invest with it.
