o California Civil Code Section 1542 - A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.I would also accept any other advice that anyone has on my current situation.

if they cash the check the lease will be implied and if it goes to court there will be nothing in writing stating what the new rent is adn the court will rule in favor of the tenant.

You may get a favorable conclusion with that lender by stating your case to them and letting them know that you will be disputing the information to the credit agencies and they can handle the response by simply not responding.
