I had an agent offer me a portion of commission for referral but another agent said that it's not technically legal so it's basically like gifting and can't be based on the sale of a property.

I will let him know that until we have confirmed dates and a deposit, I'll be showing the unit since I technically don't have an actual tenancy yet.Hopefully this will motivate him.

The building was appraised at $250,000 at the time, but Bobby bought it for $300,000 because, though, technically he did not purchase the business as well, in a sense he did because he pretty much inherited the customer base.

So technically even though they are an LLC, if they are an S-Corp I dont think I technically need to issue the 1099 MISC, but want to know either way.

Regards, RichHi Richard, Technically, you would be refinancing/pulling equity out of your relinquished property and "reinvesting" back into the property, so you should be fine.

I wonder what technically would make it my primary residence and for how long it would need to be established as my primary.I don't think it would make sense to do a cash out refi since I already have a good OO mortgage loan in the home.
