I guess my point is, we're buying this house with zero intention of wanting to keep it, so if time runs out and we don't have a buyer lined up before WE are suppose to close, we just lose the grand or two EMD and walk away??

IDK about this site, I came upon it by seraching out my rights, as I am supposed to be the mortgage buyer in a messed up owner financing (my husbands sister) printed off computer , no credit check, for debt to credit ratio(in compliance to an interest rate percentage, no attny. or loan originator, a psycho mess, for a sweet and courteous girl like me to have gotten privy to.

I suppose there isn't much harm in skimming a little off the top if you're looking to put the cash to good use, but otherwise paying tax on a large portion of the proceeds kind of defeats the purpose of the 1031 exchange.
