Although I should say we “suspected” she started smoking in the unit a while ago but that is the tricky thing about smoking, it’s very difficult to prove.

In my state and I suspect many others, the deposit money is considered to be owned by the tenants even while you are holding it.

@Steve Morris, thank you, I suspect that you are correct as well that the lender wants to have recourse if things go south.I think though, after all, that I cannot afford to not talk to a lawyer and just do the retainer in the first place, even though it will be expensive.

At present, I don't know if they are on city sewer, although I suspect they are as it's a reasonably congested part of Talladega. 

You do not state if this was your first flip, but if it was I suspect breaking even was good and you learned a lot.And you maintain a positive attitude.
