Michigan Eviction/alternative Question
Recently purchased a primary residence (Michigan) that also has a separate 2 unit rental building on the property. Was already occupied at the time. Both tenants told us upon moving in that they would be moving out in 1-2 months. Apparently they had told the previous owner this but she instructed them to not mention it to potential buyers looking at the property as it being occupied was a selling point for her. Either way it worked out for us as we planned on doing a bunch of updates to the units that would have required it being empty and now we didnt have to be the mean new landlords kicking everyone out.
Here is the current issue after 1 month ownership. Both are current on rent. Nothing is signed saying they need to be out at a certain date, we just transferred their current month-month lease over to our names. One unit does look to be actually moving, again they are under no deadline legally to get out we haven't issued any sort of notice to quit. I am fine if it takes them a month longer to get out, as long as they pay rent. The other unit we have had trouble contacting the tenant. I was called a week ago by the tenant who said they were reconsidering and might want to stay. I told them our plans of needing to do lots of work to the unit and needed it empty to complete the work and it wouldn't be back on the market for a couple months. Tenant said they understood and asked if they could have first dibs of applying once it was back. I said I would be happy to send them an application first once it was on the market. That was the last I have been able to contact the tenant. I have not seen the tenant in the unit for 3 weeks now. But I have seen her daughter who has taken up living there for the past 2-3 weeks. (Violation of current lease). Again they also have nothing signed saying they need to be out end of the month, just what they told us was their plan. This one though I am concerned about causing an issue. Police were called other day as one tenant accused the daughter of stealing a package. The daughter told me and the police she had been there for the last few weeks helping her mother pack as she was unable too. When me and the police walked through the unit, it showed no signs of anyone moving out. She claimed boxes were packed up, I seen none. It was a mess, but no damage to anything that I could tell, just messy. I have seen multiple people come and go all hours and it appears she is using it as her own place. She is not on any lease. I am trying to be polite and allow the tenant to move out as she said, end of the month. But I have still been unable to contact her.
What are my options now? Way I see it I need to wait till the end of this month. If she pays on time for the next month I then issue the 30 day notice to quit. From what I can tell with them being month to month I do not need to give reason. But I do have lease violations, her daughter staying there for over 2 weeks without notifying me. If they dont pay rent on time, do I just do the 30 day notice to quit, or the 7 day nonpayment of rent notice? I realize then they could just drag it out, pay me, then I need to start the 30 day notice to quit. So do I just go right with the 30 day regardless of late on rent or not? Looking for any tips. I have read all my state (Michigan) laws and regulations. I have researched the process of evicting and while I hope it doesnt come to that I am prepared. My biggest concern is more issues with them the longer they stick around. I cant prove anything but suspect some illegal drug activity might be going on inside. I also realize I could issue a 30 day notice now without waiting till the end of the month. I am worried that might cause some issues with them either then thinking they have more time to move if they still planned on being out in the next 1.5 weeks. Or cause them to get upset with me trying to "evict" them when they might claim they were already planning on moving out the end of the month. Any suggestions?
