first off, CONTRACT CONTRACT CONTRACT...... putting the property UNDER CONTRACT is the first step, CONTROLLING THE PROPERTY.......I always use a specific performance CONTRACT, in the buy/ sell CONTRACT unless otherwise stated is a earnest money CONTRACT, so using a specific performance CONTRACT will be binding on both sides subject to the specific details of it, so while leaving u the lead way to wiggle out of it if certain criteria isn't meet, once the CONTRACT is executed u can shop around for ur new financing, assignments, the beauty of this is actually ALLOWING you to be very artistic so use ur imagination and keep pushing.. specific performance CONTRACT is a CONTRACT which means parties can sue for specific performance...
