title company or an attorney ?
20 September 2020 | 10 replies
I am an Illinois real estate attorney and the Parties in my state are almost always represented by an attorney. The Illinois title company is very much like other title companies in other states, an impartial third party that controls the recording of documents and issue title insurance polices. However, in every state, the title company IS an impartial third party, who will not/does not decide that one party or the other is in breach of contract.Unless I am wrong, your New Jersey Title Company will not take your side in your argument that the other Party has breached the Contract, even if the title company agrees with you.As an attorney representing a Buyer or Seller, I know the laws and customs of property law and I am the first one to know how and when the other Party breaches the Contract, and then I give written notice to them that they have breached. Will your Agent be as aggressive as I will be as your attorney?
