You will also account for depreciation when you sell so your gain on paper will be more (but don't forget the owner occupant taxable gain exclusion on your primary if you lived in it 2 of last 5 years before you sell) Your calculation of 1200 expenses -1600 rent  needs also needs to include  5% capex 5 -10 % property management and any other expenses, lawn care ect.

If you're correct and the deed wasn't recorded in Nassau County then I think there would be a claim under the policy since it insures his interest to the exclusion of all others as of the date of policy.
