Assuming it's the 2nd option & referring to your Q 5 (b): lender should not be loosing any money on your deals unless they are foreclosing on your flip and obviously they will never lend to you again.

I'm not sure how much of a difference it makes that this is a promissory note, not a mortgage, and isn't technically tied to the house.I guess what I'm really trying to determine is if we can state that the loan includes the imputed interest and remove the tax liability away from the seller.

Your intitial post mentions: ""Owes= $24,000 (Charged Off but are accepting payments to principle)"If you can get that debt assigned to you then you are in the driver's seat and you have the right to remove the property from tax foreclosure in order to protect your valid lien, whether either brother likes it or not.

All,I have a rat problem that has been in one of my houses for awhile, unknown to me and I have to get it cleaned up.One company I'm working with says I need to remove all the insulation, droppings, clean and treat and reinstall new insulation.
