I think today if the parties are unrealated you might have a problem unless it's a non-owner occupied purchase.As J. mentioned it's highly unlikely IMO that they will change buyer after submitted, that would indicate to me that the buyer doesn't have their ducks in a row as well and might consider file 13.As to the QCD, this was the way to do it in the past but I believe today (as things change in RE) that there are some areas that have title issues with the QCD being used except in limited and more customary instances, like between husband and wife from a divorce.The problem seems to be that it weakens the chain of title as to "only that interest" being conveyed.

They even did a compliance review where they examined many of these ROBS transactions and issued commentary on where people stepped afoul of the rules (didn't file 5500 or 1120, went out of business, didn't value the company).

So, if the payment standard was $863 for a two bedroom unit, then the most rent the owner could charge IF ALL UTILITIES WERE PAID BY THE OWNER is $863 (if it meets rent reasonable tests).

You can discredit them in court.Typically these tenants get a pro bono attorney to try to file a bogus claim.The attorney hopes your insurance pays out instead of fighting it in court.The insurance then proceeds to raise your annual rates or drops you all together.You have to make sure to your insurance company and this attorney that you will vigorously defend yourself to the end before giving them one cent.Now if they have everything documented with date,pictures and went to see the doctor that day etc. then maybe there is a case.Most of the time these tenants are looking for a free lunch.
