What Ken is saying is that if you are a flipper, as in buying and selling multiple properties a year with no intention to hold them, then you won’t qualify for long-term capital gains tax treatment even if you hold those properties 366 days as you’ll be taxed as a real estate dealer, not an investor.

Should the seller's agent fall into this enticement, its a violation of the Realtor Code of Ethics (we assume that we are talking about residential where all agents should be Realtors).Now, when they think the agent is performing in "bad faith," for lack of a better term, now they come to the board and complain. 

If it only shows up after you arrive I don't think it is ethical.

That's an odd statement from someone who presumably understands ethics as a lender. 

These are professionals with additional training and a stricter code of ethics.

I think a lot of them are ethical but also a good handful that give wholesaling a bad name.
