Keep in mind, if you (and your broker) ever have to go to court to defend yourself, the judge will hold you at a higher standard because you have a license.

You're going to have a hard time justifying yourself to a judge if two owner occupant mortgages close within a few months of each other, assuming of course the 2nd underwriter doesn't pick up on this obvious flag for fraud, cank the deal, and put you on a list that lenders share.Best bet if you want both: You're doing 25% down anyways... switch it over to investment property financing.

Get same person to give you time estimate as well as price.You should have 30 days to return any deposit along with written explanation of funds being held for damage.So I doubt the deposit or how much you might give back will be discussed with judge during eviction.My lease clearly says that if they break lease they loose all the deposit so damage expenses may not come into play at all.

They could be compelled by a judge under threat of contempt but you are talking months and maybe years of legal wrangling (and LOTS of $$) before it ever gets to that point.
