Setting aside that it is premature at this point, ultimately if it came down to it, it may make sense to pay the debt to avoid any adverse credit consequences and then at that point sue to get it back.

In the end, we would rather have someone called pre-maturely than a potentially damaging (i.e. overflowing toilet) situation persist.

But it'd be premature to start that process now because you gave her 90 days to vacate and that time apparently hasn't expired yet. 

Update from my attorney:"If she mails the rent and it is post marked during the notice period, then you would have filed your eviction prematurely.

I guess since I am premature, I don't know what to ask for.

However, I think a pop-top or scrape and rebuild would be premature. 

The gov seems going to artificially deflate CPI.These two are very premature early signs of recovery in tech and housing.
