You really need to know the Realtor as ethically, you are making a commitment to do future business, don't beat them down and then take business to another agent on your next deal.

If the lender says no, then you are stuck with a home worth less than the loan, and either keep it as is and cry yourself to sleep every night, or give the property back to the owner (which isn't very ethically or morally right to do).

However if you are an active agent in the marketplace I think you'll find it easier to duck and weave over fighting back...And consider that it may be a Realtor violation not to disclose so if you are a Realtor I would seek clarification whether or not it is a Realtor ethics violation even if it isnt a legal violation.

dont know about your state but most realtors that market expireds will have a disclsoure at the bottom that says." if your house is currently listed please disregard this solicitation"  I think for sure you could have an ethics violation if he wanted to turn you into the board. also why would you buy a house thats only worth 310k and probably really is not.. for 275 to 290k unless your buyhing listings ??
